- The Site is operated by Southern Cross Frameless Glass ABN 35 303 669 220 (“us” or “we”) and provides information on our glazing products and services.
- Site means http://www.southerncrossframelessglass.com.au
- You should read our Terms and Conditions and consider it before making a decision whether to acquire or continue to hold any products or services purchased from us.
- By authorising or engaging Southern Cross Frameless Glass (SCFG) for its goods and services, you agree to these Terms and Conditions.
2. Compliance
- You agree to be bound by, and comply with, these Terms and Conditions.
- You agree to comply with all relevant Australian laws and laws relating to your use of the Site.
- You agree not to use any image and data listed on this site for commercial purposes.
- The work will comply with relevant building codes, standards and specifications that the work is required to comply with under law. The contract may limit the liability of the contractor for failure to comply with the above work compliance clause if the failure relates solely to: a design or specification prepared by or on behalf of the client or; a design or specification required by the client if the SCFG has advised the client that they go against the work compliance clause.
3. Contract and Service Variation
- SCFG must receive a deposit payment from the Client before glazing works can commence.
- Agreement to vary the contract or any plans and specifications to be done under the contract are taken to form part of the contract and must be in writing and agreed by both parties.
- Compliance Certificates are only issued when full payment is received for the entire contracted work.
4. Pricing, Fees and Charges
- All products and services are quoted in Australian dollars ($AUD).
- Relevant taxes are stated.
- Website pricing is only indicative. All pricing is dependent on the provision of a formal quotation and site inspection.
- Prices change from time to time and we do not provide any notice of these changes.
5. Payment Terms
- All payments must be made by the advised due dates. It is the responsibility of the Client to take into account bank clearance times.
- All supplied goods remain the property of SCFG until all outstanding payments are made. All works will halt until outstanding payments are completed by you.
- Failure to make payment will result in one or more of the following actions: caveat against your property; default against your credit report; NSW Fair Trading / NSW Civil and Administrative Tribunal notification; Statement of Claim lodgement through the Local Courts and/or Court proceedings under the Building and Construction Industry Security of Payment Act.
- Failure to make payment will also result in interest being charged retrospectively from the original invoiced date. Interest rate used will be rates set by the NSW Local Courts.
- You agree to be charged and pay for all debt recovery costs we incurr due to your failure to pay for our goods and services.
6. Legal and Liability Disclaimer
- Our glazing products and services and the information in this site and all matters relating to, are governed by the laws applicable in the State of New South Wales and the Commonwealth of Australia ("Australian law"). The information in this site is current at the date of publication but may be subject to change without notice.
- On completion date the Client acknowledges that the purchased service/product was undamaged and free from defects and the Client’s property was left in an undamaged state.
- We do not warrant or represent that the information in this site and in our products and services are free from errors or omissions or is suitable for your intended use.
- No liability is accepted by SCFG for personal injury, loss or claim or property damage, installation costs, material or other costs (whether special, consequential or otherwise) howsoever caused or arising whether direct or indirect.
- Southern Cross Frameless Glass, its operators, employees, its related companies, directors, and agents will not be liable and accept no responsibility for any loss, damage, cost or expense incurred by any person as a result of any error, supply, installation, omission or misrepresentation in any information or service supplied by us. This does not limit any rights a person may have under the Australian Consumer Law or other applicable legislation.
- This website may contain links to third party websites for your information and convenience. We are not responsible for the content of these third party sites. We will not be liable for any loss or damage resulting from your use of any aspect of these sites and such use is solely at your risk.
7. Warranty Terms on Workmanship
- At the time of works completion, the Client acknowledges that the purchased product/service was inspected by them and is undamaged and free from defects.
- Warranty becomes valid only when full payment is received for the entire contracted work.
- The warranty is only applicable where a defect has arisen wholly or substantially as a result of workmanship conducted by us.
- Claims under this Warranty should be made within one month of the defect arising and remedial works must only be performed by Southern Cross Frameless Glass personnel or our authorised agent.
- The Warranty does not cover: any loss or consequential damage incurred while product is being repaired; normal wear and tear; abuse, mishandling, accidents and/or damage caused by cleaning solvents; servicing, modifications and repairs carried out by non-Southern Cross Frameless Glass personnel or non-authorised agents
- The Client must provide original proof of service/product purchase and the date of proof must be within the Warranty period to receive any services under this warranty
- This Warranty shall be governed and interpreted according to the laws applying in the State of New South Australia, Australia and the Client agrees that any proceedings in relation to this Warranty shall be commenced in the courts of New South Wales.
8. Copyright
- Copyright in the content of this website and all material and documents created by us is owned by Southern Cross Frameless Glass unless otherwise indicated. All rights reserved where possible.
- You are not authorised or permitted to modify, alter, transfer, transmit, distribute, reproduce, interfere with the working, remove, create, distribute, paste onto, any part of the Site.
- You agree that Southern Cross Frameless Glass and their agents are able to take photographs of the products and services we provide. We have ownership and full use of these images and photographs and with or without names, may use and display them on promotional publications and websites owned by us and/or our agents.
9. Privacy Policy
- We respect your privacy. We collect, hold, use and disclose your personal information in accordance with the Privacy Act 1988.
- You acknowledge and agree that we may use your personal information in accordance with our Privacy Policy.
10. Changes to these Terms and Conditions
- We may at any time and at our absolute discretion vary these Terms and Conditions.
- For future purchases/services, these Terms and Conditions may be different and so we recommend that you read these Terms and Conditions carefully prior to making a new purchase of our products and services.
